The Nigeria’s Election Petition Tribunal of Osun had postponed the hearing of the petition between the former governor, Gboyega Oyetola, and governor Ademola Adeleke over the latter electoral victory in July.
The court which had its hearing on Friday, led by Justice Tertsea Kume’s three-man panel uphold the case, saying more information would be communicated in written addresses after their final adoption.
The state’s former governor, Oyetola have continued to challenge the victory of governor Adeleke’s electoral results from 749 polling units across 10 local government of the states.
The petition put forward by Oyetola includes thus; vote buying, electoral malpractice, and over-voting among others.
The APC counsel, Mr. Lateef Fagbemi (SAN) called for the cancelation of polling units where several votes exceeded the number of registered and accredited voters as laid down in sections 51 (2) and 47 (2) of the Electoral Act.
Among other things included is, allegations on the testimonial tendered by Gov. Adeleke is also been challenged, as there is no veracity that he attended Muslim Grammar School in Ede.
Submission of the INEC Counsel, Prof. Paul Ananaba (SAN) indicated that the Commission must certify whether Gov. Adeleke was qualified to contest which they did, and on the matter of over-voting, Counsel to INEC uphold that, should there be deduction across the polling units, the second respondent will still emerge victorious with over 20,000 votes.
Counsel to Gov. Adeleke has denounced the allegations put forward by the Counsel to APC saying, the election was conducted with BVAS, which makes their allegations invalid.
