The Manhattan District Attorney’s office has indicated that it will not oppose a request to delay former President Donald Trump’s sentencing in his criminal case related to hush money payments, originally set for September 18. Prosecutors have signaled they will defer to Judge Juan Merchan on the timing of the sentencing.
Trump’s legal team requested the delay, citing a pending Supreme Court ruling on presidential immunity, expected by September 16, just two days before the scheduled sentencing. They argue that the verdict could influence the admissibility of evidence in Trump’s trial, and if the judge does not dismiss the guilty verdict, Trump plans to appeal immediately.
In a letter made public on Monday, prosecutors acknowledged that some of Trump’s arguments lacked merit but highlighted “strong reasons” against allowing an appeal on immunity before sentencing. State attorney Matthew Colangelo stated, “We defer to the Court on whether an adjournment is warranted to allow for orderly appellate litigation.”
Prosecutors also raised concerns about the significant public safety and logistical preparations required for Trump’s court appearances, noting that last-minute appeals could disrupt these efforts. Judge Merchan’s decision to rule on the immunity issue just before sentencing adds to the potential complications.
Trump was convicted in May on 34 felony counts of falsifying business records related to a hush money payment made to adult film actress Stormy Daniels during the 2016 presidential campaign. His legal team argues that evidence presented during the trial included acts that might now be deemed protected under the Supreme Court’s upcoming ruling, potentially invalidating the conviction.
While prosecutors pushed back against Trump’s claims, the DA’s decision not to oppose the delay request suggests a willingness to accommodate the legal strategy, allowing more time to address the appeal before sentencing.
This development has drawn significant public interest, particularly with its potential impact on Trump’s ongoing presidential campaign. As the sentencing date nears, legal maneuvers surrounding Trump’s case will continue to unfold, with possible ramifications for both his political future and the broader legal landscape.
